Trading Risk Disclosure

This Trading Risk Disclosure (“Risk Disclosure”) supplements the NexTick360 Terms of Service. By using NexTick360, you acknowledge and agree to the risks described below.

1. General Trading Risk

Trading futures and other derivative instruments involves substantial risk of loss and is not suitable for all individuals. You may lose more than your initial investment. Market conditions may change rapidly. Leverage can work against you as well as for you.

You should carefully consider whether trading is appropriate for you in light of your financial condition, experience level, and risk tolerance.

2. Futures Trading Specific Risk

Futures trading involves a high degree of leverage. A small price movement may result in substantial losses. Additional risks include:

  • Margin calls and forced liquidation
  • Rapid market volatility, especially around economic releases
  • Reduced liquidity during certain trading hours
  • Slippage, gaps and execution delays
  • Exchange-imposed trading halts

You are solely responsible for monitoring your trading account and managing your risk.

3. NexTick360 Is Not Your Broker

NexTick360 provides trading software, including order entry. NexTick360:

  • Is not a broker or futures commission merchant
  • Does not hold customer funds
  • Does not execute, clear or settle trades

Orders you enter in NexTick360 are sent through your own connection to your broker and are executed by your broker. Your broker's records of your orders, fills, positions and balances are the official record. NexTick360 checks its view of your account against your broker's when it connects and reconnects, and where they differ, your broker's record is correct.

4. Order Entry Tools

NexTick360 sends orders only when you act, or under ATM brackets and guardrails you have set up yourself. Its tools act quickly and exactly as configured:

  • One-click, chart and DOM trading can send an order the moment you click. Check the account, instrument, side and size before you act.
  • An ATM bracket sends the stop and target orders you configured once your entry fills, and may move them as you set it to.
  • Stop orders can fill beyond their price in fast markets or when the market gaps.
  • An order may be rejected, delayed, partly filled or filled at a price you did not expect.

You are responsible for every order sent from your account, including orders sent by brackets and settings you configured.

5. Guardrails and Limits

Daily loss limits, maximum size, trade limits, cooldowns and lockouts are tools that act on your computer under the rules you set. They may not prevent a loss beyond a limit, for example when the market gaps, when your connection drops, or while NexTick360 is closed. They do not replace your broker's or your prop firm's own risk controls.

6. Technology and Connection Risk

Trading through NexTick360 relies on your computer, your internet connection, your broker's order and data connections, exchange systems and our cloud services. Any of them can be delayed, interrupted or fail. Among other things:

  • An order may not reach your broker, or may reach it late
  • Prices on screen may be delayed or stale
  • Your connection may drop while you have open positions or working orders
  • Your computer may crash, sleep or restart

Working orders stay at your broker when NexTick360 disconnects. Know how to reach your broker another way, such as its web platform or trade desk, to manage your positions if NexTick360 is unavailable. NexTick360 does not guarantee real-time data accuracy or continuous availability.

7. Simulated Trading

Simulated and practice trading does not reflect real liquidity, slippage, queue position or the emotional pressure of real money. Results from simulated trading do not predict live results.

8. Charts, Indicators and Analytics

Charts, indicators, footprints, volume profiles and order-flow displays are drawn from the market data your broker supplies and may differ between data sources. Journal analytics and statistics are retrospective and are not predictive.

9. Prop Firm Accounts

Figures NexTick360 shows for a prop firm account, such as drawdown room, profit target progress and consistency, are estimates made from your own trades and the numbers you entered. Your firm's own records and rules decide whether you pass, keep or lose an account.

10. No Investment Advice

Charts, indicators, alerts, guardrails, analytics, coaching tips and AI-generated content are informational tools. They are not personalized investment advice and not a recommendation to buy, sell, hold or trade any financial instrument. The AI coach answers from your own journal data, is never part of the order path, and cannot place, change or cancel an order.

11. Behavioral Insights

Behavioral insights, habit costs and coaching tips are analytical tools only. They are not medical advice, psychological diagnosis or professional mental health services. If you believe trading is affecting your mental health, consult a qualified professional.

12. TradeStation

Orders are processed by TradeStation Securities, Inc.; order entry is provided by NexTick360.
